Notice of Privacy Practices
This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Brash Technology LLC, doing business as Ear Outfitters (“Ear Outfitters”), is required by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) to maintain the privacy of your protected health information (PHI), to provide you with this notice of our legal duties and privacy practices, and to abide by the terms of this notice.
How We May Use and Disclose Your Health Information
We may use and disclose your PHI for the following purposes:
Treatment
We may use your PHI to provide, coordinate, or manage your audiological care. For example, we may share hearing screening results with a referring physician or school nurse to coordinate follow-up care.
Payment
We may use and disclose your PHI to bill and collect payment for services provided. This may include sharing information with your health insurance plan, employer (for workplace screening services), or school district as part of a service contract.
Healthcare Operations
We may use your PHI for our internal operations, including quality assessment, staff training, compliance activities, and business management.
As Required by Law
We may disclose your PHI when required to do so by federal, state, or local law, including mandatory reporting to the Texas Department of State Health Services (DSHS) for hearing screening programs.
Public Health Activities
We may disclose PHI for public health purposes, such as reporting hearing screening results to state or local health authorities as required by Texas law.
Health and Safety
We may use or disclose PHI when necessary to prevent a serious threat to your health and safety or the health and safety of others.
With Your Authorization
Other uses and disclosures of your PHI not described in this notice will be made only with your written authorization. You may revoke your authorization at any time in writing, except to the extent we have already taken action in reliance on it.
Your Rights Regarding Your Health Information
You have the following rights with respect to your PHI:
- Right to inspect and copy: You have the right to request access to and obtain a copy of your health information maintained by Ear Outfitters.
- Right to amend: You may request that we amend your health information if you believe it is incorrect or incomplete. We may deny the request in certain circumstances as permitted by law.
- Right to an accounting of disclosures: You may request a list of certain disclosures we have made of your health information.
- Right to request restrictions: You may request restrictions on how we use or disclose your PHI for treatment, payment, or healthcare operations. We are not required to agree to all requests, but we will comply with any restriction we accept.
- Right to request confidential communications: You may request that we communicate with you about your health information in a specific way or at a specific location (e.g., by mail only, or to a particular phone number).
- Right to a paper copy of this notice: You may request a paper copy of this notice at any time, even if you have agreed to receive it electronically.
Our Duties
Ear Outfitters is required to:
- Maintain the privacy of your PHI as required by law
- Provide you with this notice of our legal duties and privacy practices
- Notify you if a breach of your unsecured PHI occurs
- Abide by the terms of this notice currently in effect
Minors
Many of our services involve hearing screenings and ear mold fittings for minors. A parent, legal guardian, or authorized school official must consent to services for minors as required by Texas law. Parents and guardians may exercise HIPAA rights on behalf of their minor children.
Changes to This Notice
We reserve the right to change this notice and to make the revised notice effective for PHI we already have about you as well as any information we receive in the future. The current notice will be posted on our website and available at our office.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.
